1. Agreement to Terms

By accessing and using Goorna's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Goorna provides email marketing services including campaign creation, marketing automation, copywriting, list segmentation, A/B testing, and deliverability optimization. The specific services provided will be outlined in your service agreement.

3. Client Responsibilities

You agree to:

  • Provide accurate and complete information required for service delivery
  • Ensure you have proper consent to email your subscribers
  • Comply with all applicable email marketing laws and regulations, including CAN-SPAM, GDPR, and CASL
  • Maintain the security of your account credentials
  • Provide timely feedback and approvals when requested

4. Payment Terms

Payment is due according to the terms specified in your service agreement. All fees are non-refundable except as required by law. Services may be suspended for non-payment.

5. Intellectual Property

Upon full payment, you own the email campaigns and content created specifically for you. Goorna retains ownership of our methodologies, templates, and proprietary processes. We reserve the right to use anonymized campaign data for internal analysis and case studies.

6. Confidentiality

Both parties agree to keep confidential information private and secure. This includes business strategies, customer data, and proprietary processes.

7. Limitation of Liability

Goorna will not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for services in the preceding three months.

8. Termination

Either party may terminate services with 30 days written notice. Upon termination, you will receive all work completed to date and must pay for services rendered.

9. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the revised terms.

10. Governing Law

These terms are governed by the laws applicable in our jurisdiction, without regard to conflict of law provisions.
